Terms & Conditions

1. Payment Terms: All invoices must be paid upon completion􀆟on of works, unless prior arrangements have been made with Alpex Industries Pty Ltd.

2. Late Payments: Any invoices that are not paid within 7 days will incur additional charges. Alpex Industries Pty Ltd reserves the right to charge interest on late payments at a rate of 1.6% per month or part thereof.

3. Payment Methods: Payments can be made by electronic funds transfer, credit card, cheque, or BPAY. All payments must be made in Australian dollars.

4. GST: All prices quoted by Alpex Industries Pty Ltd are exclusive of GST unless stated otherwise. GST will be added to the invoice at the prevailing rate.

5. Quotes and Es􀆟mates: All quotes and es􀆟mates provided by Alpex Industries Pty Ltd are valid for 14 days from the date of issue. A􀅌er this period, prices may be subject to change.

6. Deposits: All quotes and es􀆟mates require a deposit of 50% of the sum-total (incl. GST) prior to work being progressed to a scheduling stage. This deposit secures the purchase of materials and locks the price. Failure to place a deposit within the allocated 30-day 􀆟me-frame, may lead to delays and cost increases.

7. Changes to Work: Any changes to the scope of work must be agreed upon in writing by Alpex Industries Pty Ltd and the client. Any additional costs incurred as a result of changes to the scope of work will be charged to the client.

8. Completion Date: Alpex Industries Pty Ltd will use reasonable efforts to complete the work by the agreed completion􀆟on date. However, the completion date may be affected by factors beyond our control, such as adverse weather conditions or unforeseen circumstances. Alpex Industries Pty Ltd will not be liable for any losses or damages arising from any delay in the completion of the work.

9. Liability: Alpex Industries Pty Ltd will not be liable for any losses, damages, or costs arising from any act, omission, or negligence of the client or any third party, includes disruptions to the client's business as a result of works undertaken at the premises.

10. Warranty: Alpex Industries Pty Ltd provides a 12-month warranty on all workmanship. This warranty covers any defects in materials or workmanship that arise within 12 months from the date of completion of the work. Any defects covered by this warranty will be repaired by Alpex Industries Pty Ltd at no additional cost to the client.

11. Dispute Resolution: In the event of any dispute arising from these terms and conditions or the work carried out by Alpex Industries Pty Ltd, both par􀆟es agree to attempts to resolve the dispute through media􀆟on. If the dispute cannot be resolved through media􀆟on, either party may refer the dispute to arbitration, with the ul􀆟mate conflict resolution op􀆟on being a decision by the Victorian Civil and Administrative Tribunal (VCAT).

12. Indemnification􀆟on: The client agrees to indemnify and hold harmless Alpex Industries Pty Ltd and its employees, subcontractors, and agents from any claims, liabilities, damages, losses, or expenses arising out of or in connection with the work performed on the premises.

13. Materials and Equipment: Alpex Industries Pty Ltd will provide all necessary materials and equipment required to complete the work unless otherwise agreed upon in writing. Any additional materials or equipment requested by the client during the course of the project will be subject to extra charges.

14. Access and Site Conditions: The client agrees to provide Alpex Industries Pty Ltd with full and safe access to the premises during the project's execution. The client will also ensure that the site is clear of any obstructions that may hinder the progress of the work. If site conditions are found to be unsafe or hinder the progress of the project, Alpex Industries Pty Ltd reserves the right to delay or halt work un􀆟l conditions are rectified.

15. Confidentiality: Both par􀆟es agree to keep all critical information obtained during the project confidential and not to disclose it to third parties without written consent from the other party.

16. Termination􀆟on of Agreement: Either party may terminate this agreement with written notice in the event of a material breach of the terms and conditions. In such cases, Alpex Industries Pty Ltd will be entitled to compensation for work completed up to the termina􀆟on date.

17. Force Majeure: Alpex Industries Pty Ltd shall not be held liable for any delays, disruptions, or failures in performance caused by circumstances beyond reasonable control, including but not limited to acts of nature, labour disputes, government actions, and unforeseen events.

18. Severability: If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

19. Entire Agreement: These terms and conditions constitute the entire agreement between Alpex Industries Pty Ltd and the client and supersede all prior understandings, agreements, or representations, whether written or oral.

20. Acceptance of Terms: The client acknowledges that they have read, understood, and accepted these terms and conditions by proceeding with the project.
